Subdivision Review

Nevada Revised Statutes (NRS) Chapter 278.335

Subdivision review requires a copy of all tentative subdivision maps to be submitted to DWR for review. There is a fee required for the tentative review only, of $150 plus $1 per lot on the tentative map. Also required for approval is a valid will serve letter from the water purveyor. Once approved, the final subdivision map can then be signed by DWR. The jurat to which DWR signs guarantees water quantity to the subdivision. It is because of this "guarantee" that DWR must review and take into account the purveyor's water rights. Some of the issues that are a part of the review are:

is there sufficient water for the subdivision;
is it for the correct manner of use;
is the subdivision within the correct place of use and if not, is there an expansion of the service area pending;
verify surface water rights versus groundwater;
check for decreed water;
verify water agreements between purveyors;
check for drought factors;
verify PUC water use duties dependent on lot size;
is a relinquishment of water rights for domestic well subdivisions required.
