Mr. Taggart and Mr. Herskovits: As to your emails regarding issues as to Dr.
Myers’ model files and versions of software used, I first note that I find it
concerning that this type of issue is being addressed via email only addressed
to us. Mr. Herskovits is taking the lead
for many other parties in this matter and they are building cases off of his
case. They are not noticed on your
emails of your issues and we do not see this as a procedural question. We believe that you should be resolving this
matter between yourselves or you should formally present your objections as to
the modeling evidence as a part of the cases you present. I encourage you to resolve this problem
promptly as we do not want to be arguing exclusion of evidence at the
hearing. I remind you that the State
Engineer’s instruction was that any model used in this hearing must be able to
be run by other parties. This means that
the model is publically available at no additional cost.

Hi Rick and Susan:
Yesterday evening, Paul Taggart
emailed me letting me know that in their review of Tom Myers’ reports and data
files, they determined that they were missing the same two folders you called
about (which we already have sent to you on disks). In addition, however,
they determined that another model run described in Myers’ Part C report on
Spring Valley also was missing from the disk of Tom’s data files. They
label this run as “SNWA pumping 60 kaf transient solution for Spring Valley.”
I checked with Tom about it this
morning, and he was surprised and apologized for having forgotten to send that
folder of data files with the rest. He has now sent that to us, and we
are sending it to you, SNWA, and the rest of the parties to make sure everyone
has a full set of Tom’s data files. (Tom labels the folder of data files
for the additional model run identified by SNWA as “modflow spring snwa pumping
60 kaf.”)
With regard to the Groundwater
Vistas software issue raised in Paul’s email today, I have consulted with Tom
about the issue and believe that SNWA is mistaken. Tom reports that he
produced and sent straightforward MODFLOW files, as required by the State
Engineer and as he did for both the 2006 Spring Valley and 2008 Cave, Dry Lake,
and Delamar Valleys hearings, which are all that is required to run his
model. Tom added that the Groundwater Vistas software is not necessary at
all to run the model.
So, GBWN disagrees about the need
for the Groundwater Vistas software to run Tom Myers’ model.
