Since October 1, 1995, water right owners have been using the Report of Conveyance submission process to update NDWR ownership records. Water rights are considered real property and must be conveyed by deed and recorded with the appropriate county where the water is diverted and used beneficially. Anyone who acquires water rights must submit a Report of Conveyance, an Abstract of Title, a complete chain of title (including copies of all recorded deeds from the current owner within NDWR records), and any applicable fees to the Division.
