Hearing Procedures (NAC 533)
The Division is proposing permanent regulations on rules of procedure for hearings before the State Engineer and pre-hearing procedures. This initiative started in 2020 with regulations proposed under R125-20, continued under R142-22, and is currently advancing with the draft regulation under R164-24. Review of Extension of Time Regulations (NAC 533.390 – 533.500)
Nevada Administrative Code (NAC) 533.390–533.500, effective December 22, 2022, govern applications for extensions of time to complete construction or apply water to beneficial use. These regulations require the Nevada Division of Water Resources to review their provisions at least once every three years.
As part of this review, the Division hosted a public meeting on October 15, 2024, to discuss the Extensions of Time process, including the regulations' impact since their adoption and potential areas for revision. The Division appreciates the valuable participation and feedback provided during this meeting.

Licensed Well Drillers (NAC 534)
The Division is proposing temporary regulations regarding well driller licensing in Nevada. These changes include eliminating the requirement that qualifying well-drilling experience must be obtained within the five years prior to submitting an application and reducing the number of required professional references from four to three, with all references to be accepted before eligibility to take the written exam. Additionally, the proposed regulations would remove the requirement for applicants to provide a public land survey description of a well’s location on a topographic map as part of the testing process. A new provision is also being introduced to establish a pathway for licensed well drillers from other states to apply for reciprocity and become licensed in Nevada.
