2025 Regulation Update

The Division is resuming its evaluation of the Extension of Time regulations and will hold a public meeting on Tuesday, September 9, 2025.

Building on discussions from October 2024, the meeting will summarize prior feedback and present recent data, review draft updates to Forms 1021 and 1022, discuss initial regulatory concepts and process improvements, and outline next steps

The Division is also seeking public input on draft revisions to:

• Form 1021 – Extension of Time for Proof of Completion

• Form 1022 – Extension of Time for Proof of Beneficial Use

Review of Extension of Time Regulations (NAC 533.390 – 533.500)

Nevada Administrative Code (NAC) 533.390–533.500, effective December 22, 2022, govern applications for extensions of time to complete construction or apply water to beneficial use. These regulations require the Nevada Division of Water Resources to review their provisions at least once every three years.As part of this review, the Division hosted a public meeting, to discuss the Extensions of Time process, including the regulations' impact since their adoption and potential areas for revision.
